Creators Educational Trust & KN Properties approached our planners with a proposal back in 2013 when they acquired four adjoining residential sites. The proposal put forward by our clients sought to establish a new purpose-built early learning centre to cater for 80 children on the rear portion of the site and relocate three of the existing residential houses within the site, all of which once the process was complete would be held in fee simple formats including the childcare centre.
Early on in the process and during the planning stage, our planners in discussions with the architect decided to split the childcare building into two blocks to achieve a lighter activity status under the Hamilton District Plan. This also had the benefit of narrowing the matters that Council could consider in their assessment. One block was to accommodate the preschool and the other the children aged under two years. These blocks were then joined by a glazed atrium space, giving the visual impression of two smaller centres whilst providing continuity and function as required by the client.
With the development strategy in place and moving forward with the client’s vision, our planners prepared and lodged a resource consent application that sought to amalgamate the residential sites into a single site to maximise the development controls of the District Plan.
Once the amalgamation had been approved by council, it was then sought to remove the house that was sited at 41 Rutherford Street and relocate the house within the amalgamated site that was established at 33 Rutherford Street. The existing houses located at 35 and 37 Rutherford Street were to be retained in their existing locations.
As a result of the relocation and removal of the houses at 33 and 41 Rutherford Street, a vacant section of land was made available to the rear of the site on which it was proposed to establish the childcare centre.
The centre once constructed would comprise a single level building designed to cater for the various needs of children based upon their age in accordance with MoE Early Childhood Education requirements. The centre would cater for children up to the age of 5 and would operate Monday through Friday from 7:30am to 5:30pm.
While the application did not proceed through council on a non-notified basis, our team of experts (planning, acoustic, traffic and civil) were able to prepare and present a solid case at the one day hearing which demonstrated to the Commissioners that any adverse effects could be avoided, remedied or mitigated. The consent was subsequently granted 15 days after the hearing was closed subject to standard conditions of consent. The building consent was then lodged.
